Chapter 14 Aayan

As Aayan listened to Syed and Garrett continue their consultation, aware that he probably shouldn’t have barged in but unable to either keep away from Garrett or stop himself from worrying about what was going on with Syed, his concern grew.

When he’d first realized Garrett was proposing another plea bargain, he’d been angry. He’d told Garrett Syed was innocent. Nothing less than complete exoneration would be acceptable. Syed would not do jail time. Aayan had promised Anne and Baba he would manage the situation satisfactorily.

But as Garrett detailed the terms of the deal, Aayan began to understand why he was pushing it so hard. It was possible Syed wouldn’t go to jail at all, and if he did, his time served would certainly be less than a year. But no. How could that be okay, that Syed should go to jail for even six months? It wasn’t okay.

Except, what if the gamble didn’t pay off? What if Syed was convicted? That was what Garrett kept trying to make them understand. No one could guarantee Syed wouldn’t be convicted—not Garrett, and not him either.

If he put the situation in business terms, the plea bargain was an insurance policy—a guaranteed minor outlay in exchange for removing the risk of a potentially much larger outlay. If he put the situation in business terms, he would take the deal every time.

“What do you mean about consent not being a defense?” he asked, interrupting the discussion. He’d been assuming that if Garrett could make it clear during trial that Jamie was a willing participant in Syed’s kink, it would take all the air out of the prosecution’s case.

“I meant that I can’t find any case law where the victim’s participation in a consensual sexual act worked as a defense against a charge for a violent crime. You can’t consent to your own murder, for instance.”

“Well, murder.”

“Exactly. That’s why the lack of precedent isn’t as bad as it sounds. The State doesn’t tend to interfere in people’s sex lives these days, not without cause. If there’s a charge brought, it’s because something went wrong. That recent case that was in all the papers, for instance, where a college kid strangled his girlfriend during rough sex.” Garrett made finger-quotes around ‘rough sex,’ his expression disgusted. “Whether they were BDSM practitioners or not, that guy deserved to be convicted.”

Syed nodded. “Breath play is serious shit.”

“Right,” Garrett agreed. “It’s the Dom’s job to maintain control of the situation, and if he fucks it up, maybe that’s manslaughter, not murder, but BDSM isn’t an excuse; it’s an extra layer of fucked-up because that person trusted you.”

Syed nodded again. Aayan hoped to God neither Syed or Garrett fucked around with breath play. He couldn’t imagine anything less sexy than Garrett not being able to breathe. Except what about the way he’d rammed his cock down Garrett’s throat the other night? Did that count as breath play? Fuck, he had no idea what he was doing.

“Any case I looked at where the rough sex defense was tried and failed, there was serious harm,” Garrett went on.
